Terms of Service

ARCANAI ("the Service", "we", "us") is a privacy-first AI platform operated by ARCANAI, based in France. The Service provides confidential document analysis and anonymous AI chat accessible at arcanai.co.

By creating an account or using the Service, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

ARCANAI is intended for use by individuals who are at least 18 years of age. By creating an account or using the Service, you represent and warrant that you meet this age requirement.

If you are under 18, you are not permitted to create an account or use the Service. We reserve the right to suspend or terminate any account if we become aware that the account holder does not meet this eligibility requirement.

ARCANAI offers the following plans:

Pay-per-use credits are also available for users who prefer not to subscribe: Boost (5 credits / €2), Power (20 credits / €7), Mega (40 credits / €10). 1 credit = 1 chat message or 1 document analysis. Credits never expire.

Using your own Claude, OpenAI, or Gemini API key does not consume credits or count against monthly quotas on paid plans.

We reserve the right to adjust pricing with at least 30 days' notice to existing subscribers. Price changes do not apply to the current billing period.

You agree not to use the Service to:

• Process, generate, or distribute illegal content of any kind.
• Violate any applicable law or regulation, including data protection laws.
• Attempt to reverse-engineer, scrape, or extract data from the Service.
• Circumvent rate limits, authentication, or other security controls.
• Impersonate any person or entity, or misrepresent your affiliation.
• Use the Service for spam, phishing, or any fraudulent purpose.
• Upload content that infringes intellectual property rights of third parties.
• Attempt to re-identify anonymized data or circumvent the PII anonymization layer.

We reserve the right to suspend or terminate any account that violates these Terms, with or without prior notice, at our sole discretion.

You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately at contact@arcanai.co in the event of any unauthorized access or suspected breach.

Each account is for a single individual. Sharing accounts is not permitted. Team access is available via the Team management feature.

ARCANAI acts as a privacy-preserving relay between you and third-party AI providers (Anthropic, OpenAI, Google). We do not generate AI responses ourselves and have no control over their content.

To the maximum extent permitted by applicable law, ARCANAI shall not be liable for any loss or damage arising from:

• Inaccurate, incomplete, or misleading AI-generated content.
• Decisions made based on AI results.
• Temporary service unavailability due to third-party AI provider outages.
• Data loss caused by circumstances outside our reasonable control.

Our total liability for any claim under these Terms shall not exceed the greater of (a) €100 or (b) the total amount paid by you in the three months preceding the event giving rise to the claim.

Payments are processed by Stripe. By purchasing a plan or credit pack, you authorize ARCANAI to charge your payment method for the applicable amount.

Subscriptions are billed monthly in advance. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused days.

Credit packs are one-time, non-refundable purchases once any credits have been consumed. If no credits have been used, you may request a refund within 14 days of purchase by contacting contact@arcanai.co.

If a subscription payment fails, access is automatically downgraded to the Free plan until the payment is resolved.

The Service, its design, code, logo, and branding are the exclusive property of ARCANAI. You may not copy, reproduce, or create derivative works without our express written consent.

You retain full ownership of any content you upload. By using the Service, you grant ARCANAI a limited, non-exclusive, revocable licence to process your content solely for the purpose of providing the Service. We do not use your content to train AI models and do not store it beyond the processing window.

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. We encourage you to read it carefully before using the Service.

The Service integrates with Anthropic, OpenAI, and Google (AI providers) and Stripe (payments). Your use of these services is also governed by their respective terms and privacy policies. ARCANAI is not responsible for the practices of these third parties.

We reserve the right to modify or discontinue any part of the Service, or to update these Terms, at any time. We will give at least 14 days' notice of material changes via email or in-app notification. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

These Terms are governed by the laws of France. Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the competent courts of Paris, France.

EU consumers: mandatory consumer protection provisions of your country of residence remain applicable and are not affected by these Terms.

UK users: applicable UK consumer law continues to apply. Nothing in these Terms affects your statutory rights.
