Terms of Service

ARCANAI ("the Service", "we", "us") is operated by Arthur von der Heyden, a sole trader registered in France. The Service provides confidential document analysis and anonymous AI chat capabilities accessible at arcanai.app.

By creating an account or using the Service, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

ARCANAI currently offers two tiers:

• Free — 3 welcome credits on signup, 1 credit per analysis or chat message, short cooldown between analyses on free accounts.
• Pro ($9/month) — Unlimited analyses and chats, no cooldowns, access to all currently available AI models, priority support.

Credits are consumed at a rate of 1 credit per analysis or chat message. Credits purchased in packs do not expire. The Pro subscription grants unlimited usage during the active subscription period. Only Claude (Anthropic) is available at this time — additional AI models are in development.

You agree not to use the Service to:

• Process, generate, or distribute illegal content of any kind.
• Violate any applicable law or regulation, including data protection laws.
• Attempt to reverse-engineer, scrape, or extract data from the Service.
• Circumvent rate limits, authentication, or other security controls.
• Impersonate any person or entity, or misrepresent your affiliation.
• Use the Service for spam, phishing, or any fraudulent purpose.
• Upload content that infringes intellectual property rights of third parties.

We reserve the right to suspend or terminate any account that violates these Terms, with or without prior notice.

You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately at security@arcanai.app of any unauthorized access.

We may require you to choose a strong password. You must not share your account with third parties. Each account is for a single individual; team access is available via the Team management feature on the Enterprise plan.

ARCANAI acts as a relay between you and third-party AI providers(currently Anthropic Claude; additional providers are in development). We do not generate AI responses ourselves.

AI results are provided "as-is" and without warranty of any kind. They may contain inaccuracies, omissions, hallucinations, or outdated information. You must not rely solely on AI-generated results for medical, legal, financial, safety-critical, or any other consequential decisions.

To the maximum extent permitted by applicable law, ARCANAI shall not be liable for any loss or damage arising from:

• Inaccurate, incomplete, or misleading AI-generated content.
• Decisions made based on AI results.
• Temporary service unavailability due to third-party AI provider outages.
• Data loss caused by circumstances outside our reasonable control.

Our total liability to you for any claim arising under these Terms shall not exceed the greater of (a) €100 or (b) the amount paid by you in the three months preceding the event giving rise to the claim.

Payments are processed by Stripe. By purchasing a plan or credit pack, you authorize ARCANAI to charge the applicable fees to your payment method.

Subscriptions are billed monthly in advance. You may cancel at any time; cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused days within a billing period.

Credit packs are one-time purchases and are non-refundable once credits have been used. If credits have not been used, you may request a refund within 14 days of purchase by contacting billing@arcanai.app.

If a payment fails, access may be downgraded to the Free plan automatically.

The Service, its design, code, logo, and branding are the exclusive property of Arthur von der Heyden. You may not copy, reproduce, or create derivative works without our express written consent.

You retain ownership of any content you upload. By using the Service, you grant ARCANAI a limited, non-exclusive licence to process your content solely for the purpose of providing the Service. We do not use your content to train AI models.

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. We encourage you to read it carefully.

The Service integrates with Anthropic, OpenAI, Google (AI providers), and Stripe (payments). Your use of these services is also subject to their respective terms and privacy policies. ARCANAI is not responsible for the practices of these third parties.

We reserve the right to modify or discontinue any part of the Service, or to update these Terms, at any time. We will provide at least 14 days notice of material changes via email or in-app notification. Your continued use after the effective date constitutes acceptance.

These Terms are governed by the laws of France. Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Paris, France.

Users in the United Kingdom are also protected by applicable UK consumer law. Nothing in these Terms affects your statutory rights.

For users in the European Union, mandatory consumer protection provisions of your country of residence remain applicable.
